A Delhi court on Thursday sent four students to two days’ police custody for allegedly assaulting policemen during a protest against rising air pollution in the national capital held at India Gate on Sunday.
In their custody application filed for 17 accused persons (including 11 women), the police claimed that the protesters had conspired to commit offences against the state. The application sought seven days’ custody of five of the 17 protesters, along with an extension of the judicial custody of the remaining 12.
Judicial Magistrate Sahil Monga of Patiala House Courts granted two days’ police custody for four accused individuals, while sending the remaining 13 to one-day judicial custody. The accused were booked at the Sansad Marg police station under various provisions of the Bharatiya Nyaya Sanhita (BNS), including obstructing a public servant, conspiracy to commit offences against the state, and wrongful restraint.
The order came a day after Judicial Magistrate First Class Aridaman Singh Cheema of Patiala House Courts granted the police three days’ custody of six individuals accused of acting against the state during a similar anti-pollution protest. In its appeal, the police stated that the accused, mostly students, had used pepper spray on policemen, blocked public roads, raised “pro-Maoist” slogans and expressed support for Madvi Hidma, a Maoist leader killed in Andhra Pradesh earlier this month. A total of 23 students have been arrested after two FIRs were registered at Kartavya Path and Sansad Marg police stations on November 23.
