The Madurai Bench of the Madras High Court on Tuesday ordered notice to CB-CID on a petition filed by suspended Sub-Inspector of Police K. Saravanan, the father of Surjith, the main accused in the case of Tirunelveli caste killing of techie Kavin Selvaganesh.
Mr. Saravanan sought a direction to the Second Additional District Court (PCR) in Tirunelveli to furnish the police reports and other documents relied upon by the prosecution. He said that the non-supply of mandatory documents despite his consistent appearance before the trial court and filing copy applications was impairing his right to effectively prepare his defence and infringing the guarantee of a fair trial under Article 21 of the Constitution.
The right of an accused to receive the documents and statements submitted before the court is absolute and must be adhered to by the prosecution and the court, he said, adding that the continuation of proceedings without supplying the mandatory copies constitutes an abuse of the process of the court and causes serious prejudice to the petitioner.
He sought a direction to the trial court in Tirunelveli to furnish the copies of the police reports and other documents under Section 230 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, to him.
Justice L. Victoria Gowri posted the matter for hearing after two weeks.
IT employee Kavin Selvaganesh, 27, belonging to a Scheduled Caste, from Arumugamangalam near Eral in Thoothukudi district was in a relationship with Siddha doctor S. Subhashini of Palayamkottai, who belongs to an intermediate caste.
Kavin was murdered on July 27, 2025, allegedly by Ms. Subhashini’s younger brother Surjith. The police arrested Surjith, his father Saravanan, and cousin Jayapal for assisting him. Surjith’s mother Krishnakumari, also a Sub-Inspector of Police, has also been placed under suspension.
