Defaming complainant in sexual abuse case: court rejects bail plea of Rahul Easwar

The Thiruvananthapuram Additional Chief Judicial Magistrate Court on Saturday rejected a bail plea moved by YouTuber Rahul Easwar, who is accused of defaming and revealing the identity of a woman who has accused Palakkad MLA Rahul Mamkootathil of rape and coerced termination of pregnancy. The counsel who appeared for Mr. Easwar argued that the video made by the accused only showed him reading the First Information Report (FIR) registered in the rape case and it did not contain anything that defamed the complainant. He also expressed his willingness to withdraw the post from social media platforms.

However, the prosecution argued that Mr. Easwar was not cooperating with the investigation, and he had to be questioned in custody again. The prosecution also argued that Mr. Easwar had posted defamatory posts besmirching the name of the survivor before as well, and granting bail in this case would send a wrong message to society.

The court then rejected the plea.

The police team investigating the case has decided to question Mr. Easwar in custody, and a custody application will be moved in the court soon.

Meanwhile, Mr. Easwar, who was arrested by the Cyber p​olice, has been admitted to the Government Medical College Hospital, Thiruvananthapuram, after his health deteriorated. Mr. Easwar has been on a hunger strike since being admitted to jail. Mr. Easwar had also filed a bail petition in the District Sessions Court. His plea was taken up by the Additional Chief Judicial Magistrate Court on Saturday after the bail petition moved in the District Sessions Court was withdrawn.
