The Vigilance and Anti-Corruption Police have registered case against five persons, including a Senior Revenue Inspector and a Village Administrative Officer, for allegedly preparing fraudulent documents for illegally taking possession of 3.70 hectare (9.14 acre) land belonging to a woman.
According to the complainant A. Pappathiammal of Muthukrishnapuram here, she owned a ‘grama natham’ property with an extent of 3.70 hectares at Maappillaiyoorani village on Thoothukudi outskirts and the ‘grama natham’ patta for this property was issued in her favour on February 5, 1996. When one S. Madasamy Pandian tried to take control of this property, Ms. Pappathiammal, who had constructed a hut on this property and was paying tax, filed a suit before Principal District Munsif Court for injunction restraining him with the possession and enjoyment of the property.
After the Principal District Munsif Court’s verdict went in her favour, Madasamy Pandian preferred an appeal before the Subordinate Court, Thoothukud, which also confirmed the judgment of Principal District Munsif. His appeal before Madurai Bench of Madras High Court too went in favour of Ms. Pappathiammal and Madasamy Pandian did not prefer an appeal against the order of Madurai Bench of Madras High Court.
Against this backdrop, Madasamy’s wife M. Elangamani of Tharuvaikulam, her relatives senior revenue inspector S. Muthusaravanan of Tharuvaikulam, his wife M. Petchiammal, and M. Muthu Umayanan, also from Tharuvaikulam, conspired with A. Rajesh Kannan, then Village Administrative Officer of Maappillaiyoorani to create fake document and included the name of Elangamani in joint patta. Rajesh Kannan also issued an enjoyment certificate stating that Elangamani had been enjoying 1.55 cents in the property of Ms. Pappathiammal and that Elangamani possessed an asbestos-sheeted house there.
Even though Rajesh Kannan, having custody of revenue records and known well that the property was ‘grama natham’ being enjoyed by Ms. Pappaathiammal, he colluded with Elangamani, Muthusaravanan, Petchimmal and Muthu Umayanan and gave the ‘enjoyment certificate’ in favour of Elangamani.
With the fabricated document, Muthu Saravanan prepared a sale document for this 1.55 cents land and Elangamani transferred the property in favour of Muthu Umayanan. Muthu Saravanan was the witness to this sale deed executed in 2020. Subsequently, Muthu Umayanan alienated the 1.55 cents and another 1.95 cents in another land in favour of Muthu Saravanan’s wife Petchiammal, for which also Muthu Saravanan was the witness by attesting the documents at the time of registration.
Since the all the five including two government servants have colluded to commit the crime, the Vigilance and Anti-Corruption police have registered case under Section 120 B (criminal conspiracy), 464 (making a false document), 465 (punishment for forgery), 468 (forgery for the purpose of cheating), 471 (fraudulently or dishonestly using forged document as genuine) of Indian Penal Code Section 13 (2) read with 13 (1) a of the Prevention of Corruption Act, 1988.
