A case has been registered against 10 persons, including former Congress Minister M.O.H.F. Shahjahan and his wife, under several sections of Bharatiya Nyaya Sanhita and Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, following a court order in connection with a case of alleged criminal trespass and threat to life in Puducherry.
The case was registered by the P.C.R Cell of the territorial police following an order issued by the Second Additional Sessions Judge Court under sections 296, 329 (1), 351 (2), 351 (3), 335, 336 (2) of BNS read with 3 (5) of the act and 3 (1) (f) (g) of SC/ST Act, 1989. Along with Mr. Shahjahan and his wife, their close relatives are among the accused in the case.
According to police, the complainant Periyasamy, a resident of Kamaraj Street in Thattanchavady, belonging to the Scheduled Caste community was running a petrol pump in a leased property owned by Mr. Shahjahan’s family for several years at Thattanchavady. He has accused the family of trying to “grab leasehold property by wrongful occupation”.
“Further, the accused persons have joined together and criminally trespassed into the business premises and tried to evict the complainant from his lawful possession and threatened him with dire consequences. Based on the court order, we registered a case and started investigation,” said a police officer.
