The Madurai Bench of the Madras High Court has directed Aavin Commissioner to conduct an inquiry into the alleged irregularities into agro waste fire briquettes tender issued by Tiruchirappalli District Cooperative Milk Producers Union.
The court was hearing a petition filed by Amutha, proprietor of A.R. Fire Briquettes, who sought a direction to authorities to conduct an inquiry into the alleged illegality into the agro waste fire briquettes tender.
Justice B. Pugalendhi observed that the primary contention of the petitioner was that though she was selected in the e-tender for 2024–26 period, supplies were made without any formal agreement or security deposit as mandated under the tender conditions.
It was unclear from the records whether the mandatory agreement under Clause 20(a) was ever executed or whether the petitioner tendered the required security deposit. Even tender cancellation proceedings did not reveal whether any agreement was entered into prior to cancellation, the court observed.
The court directed the Aavin Commissioner to consider the petitioner’s representation made in July 2025, conduct an inquiry into the alleged irregularities, particularly with respect to non-execution of the tender agreement and issuance of orders contrary to the tender conditions, and take appropriate action, if any irregularities were found.
The exercise should be completed within 12 weeks, the court directed.
The court observed that insofar as the cancellation of the tender on the ground of alleged collusive bidding was concerned, it was open to the petitioner to challenge it in the manner known to law.
