HC orders re-post mortem of body of 19-year-old remand prisoner

The Madurai Bench of the Madras High Court on Thursday ordered re-post mortem of the body of a 19-year-old remand prisoner who was lodged in Tiruchi Central Prisoni.

The court was hearing the petition filed by K. Revathi of Perambalur district, the mother of the deceased remand prisoner, Subin Kumar. The petitioner said a false case was registered against Subin for alleged possession of ganja.

Her son was remanded in judicial custody and lodged in the Tiruchi prison. Under these circumstances, she said, she received a phone call stating that Subin had died in the prison.

The prison authorities told her that her son had fallen into a water tank due to an epileptic seizure. However, the petitioner said it was impossible for her son to drown in a tank of that size. She said he had no medical condition.

She said the explanation given by the prison authorities was false, contradictory and suspicious. Her son might have been subjected to custodial violence or there could have been a grave negligence on the part of the prison authorities that led to his death.

She said the incident took place in the Tiruchi prison and senior officials were involved. Therefore, it was just and fair to entrust the investigation to the CBI or the CB-CID for a fair and transparent investigation, she said.

She also sought a direction for re-post mortem as per the guidelines, necessary action against the officials involved and adequate compensation.

Justice Sunder Mohan ordered that the re-post mortem of the body be conducted at Mahatma Gandhi Memorial Government Hospital in Tiruchi. The court also directed the family to receive the body after the procedure. The court directed the authorities to file a report and posted the matter for hearing to November 19.
