A Mangaluru district court has granted bail to four persons accused of assaulting a migrant labourer from Jharkhand by branding the latter as Bangladeshi, while taking note of the victim’s opposition to the grant of bail.
The 3rd Additional District and Sessions Judge, Mangaluru, S.G. Sunitha, on Saturday, ordered release of R. Radheesh Das, 32, Dhanush, 24, Sagar, 23, and Mohan Das, 40, who were arrested by Kavoor police for abusing and assaulting Diljan Ansari, on January 11.
The Judge ordered release of the four persons on execution of personal bond for a sum of ₹ 1 lakh each with one surety for the like sum. While directing the accused not to tamper or threaten complainant or any other prosecution witnesses, the Judge said the four accused should be present before the trial court on all hearing dates. The accused should appear before Station House Officer and mark attendance on every 3rd Saturday, till conclusion of the trial.
The Judge made mention of the 2018 Supreme Court ruling, which complainant Ansari had cited in his objection to the bail application. In the ruling, the apex court observed : “No citizen can assault the human dignity of another, for such an action would comatose the majesty of law. In a civilised society, it is the fear of law that prevent crimes. When preventive measure face failure, the crime takes place and then there have to be remedial and punitive measures. Steps to be taken at every stage for implementation of law are extremely important.”
According to the complaint, the accused waylaid Ansari while he was proceeding to a chicken shop near Kulur Church on January 11 evening. After asking his name and community he belongs to, the accused abused Ansari by calling him as Bangladeshi, even while the latter showed copy of the Aadhaar card in his mobile. The accused snatched the mobile phone and threw it on the ground. They tore his shirt and further assaulted Ansari by using a mason equipment, Ansari stated.
The Kavoor police registered Ansari’s complaint in the early hours of January 12 and arrested the four accused persons for offences under Sections 109, 118(1), 126(2), 351(3), 352, and 353 of Bharatiya Nyaya Sanhita.
