The Madurai Bench of the Madras High Court has dismissed a petition that sought a direction to the authorities to prevent unauthorised collection of amounts in direct purchase centres (DPCs).
The petitioner N. Thangachamy sought a direction to authorities to prevent unauthorised collection of amounts in DPCs and interference by unauthorised agents and middlemen.
He sought a direction to the Centre and the State to constitute an independent expert committee to ascertain the actual comprehensive cost of paddy cultivation in Tamil Nadu and ensure fixation of the Minimum Support Price in line with the recommendations of the National Commission on Farmers.
A Division Bench of Justices C.V. Karthikeyan and R. Sakthivel took into account that the same petitioner had filed a similar petition earlier.
A Co-ordinate Division Bench of the court had dismissed the earlier petition stating that the petitioner had sought an omnibus prayer and without any particulars. The petitioner, as a matter of right, cannot seek such omnibus prayer in the name of Public Interest Litigation, the court had said.
The very same relief had been sought now. We cannot sit in appeal over or review the order of the Co-ordinate Division Bench, the court said and dismissed the petition.
