High Court notices to two BRS MLCs

Justice B.R. Madhusudhan Rao of the Telangana High Court on Monday issued notices to BRS MLCs Thatha Madhusudhan and N. Naveen Kumar Reddy in a criminal petition filed by police seeking a direction to set aside a local court order rejecting the remand of the two MLCs in a case of alleged abusing of Assembly Speaker. 

The two MLCs were arrested on September 8 over an altercation with the police outside the Assembly the previous day. The police invoked section 353 reads with 3 (5) of Bharatiya Nyaya Sanhita and 3 (1) (r) and 3 (2) (vii) of the Prevention of Atrocities against the Scheduled Castes and Scheduled Tribes Act. The First Additional Chief Judicial Magistrate at Nampally, however, declined to remand the two arrested MLCs in judicial remand contending that the mandatory notices under section 35 (2) of the Bharatiya Nyaya Suraksha Sanhita were not issued to the accused. Aggrieved by the local court order rejecting the remand of the accused, the police filed the criminal petition. 

The Sultan Bazar Assistant Commissioner of Police M. Mattaiah, who filed the petition, contended the local court passing an order to furnish personal bonds and two sureties of ₹ 20,000 bond each resulting in the release of the accused was arbitrary and illegal. This order amounted to granting bail to the accused MLCs, the ACP said in the petition. 

The matter was adjourned to Wednesday for next hearing.
