J&K High Court sets next hearing date of AAP MLA Malik for December 27

The Jammu & Kashmir High Court on Thursday (December 18, 2025) heard the Public Safety Act (PSA) case of Aam Aadmi Party (AAP) legislator Mehraj Malik, who has spent around 100 days in jail, and set December 27 as the next day of hearing.  

“The lawyers representing MLA Malik concluded their arguments and placed relevant judgments before the court in the case. In the past two hearings, the lawyers argued for more than six-and-a-half hours. The court will hear the arguments of the J&K Government on the grounds of detention on December 7,” Advocate Zulkarnain Choudhary, one of the lawyers representing MLA Malik, said.  

Mr. Choudhary said the case was important for the J&K Government as well as people. “A sitting legislator has been illegally booked. There is an abuse of power and malafide exercise of the government as the detention order passed by the Deputy Commissioner on the basis of daily diary of the police. We have challenged the same,” Mr. Choudhary said.

This is for the first time that a sitting MLA has been detained under the PSA, a law that allows detention without charge or trial for up to two years. Mr. Malik won the 2024 Assembly elections and defeated a BJP candidate. Earlier, he had won the District Development Council elections from Kahara constituency of Doda in 2020.
