Kerala HC grants bail to teacher accused in Vadakara MDMA case

The Kerala High Court has granted bail to one of the five accused in the alleged drug trafficking case in Vadakara.

K. Kavya, the third accused in the case, was one of the three special educators arrested for allegedly functioning as financial intermediaries for inter-State drug traffickers.

Justice Kauser Edappagath noted that Ms. Kavya was remanded in judicial custody on July 25 and that the investigation was almost done. The court recorded that she did not have any criminal antecedents, and thus her continued custody was unnecessary. 

The court allowed the bail application, imposing conditions including a bond for ₹1 lakh with two solvent sureties, full co-operation with the investigation, weekly check-ins with the investigating officer, and restriction of travel outside Keralam. 

Ms. Kavya was charged with conspiracy for unlawful manufacture, possession, sale, purchase, transport, import/export, or use of psychotropic substances. The prosecution alleged that Ms. Kavya, along with the remaining accused, conspired to transport and sell narcotic drugs.

Subsequently, in the early hours of June 28, the first accused was found in possession of 2.108 grams of MDMA from Vadakara. It was contended that the financial transactions were made through Ms. Kavya’s bank account, violating the provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The court had earlier granted bail to K.C. Keerthana, the second accused and a former teacher at the Perambra Block Resource Centre, who was allegedly involved as a financial intermediary in the alleged drug trafficking.
