NMPA filed a false complaint against me, says former MLA Mohiuddin Bava

Former MLA B.A. Mohiuddin Bava has denied allegations that he attempted to obstruct and threaten a public servant — Deputy Chairperson of New Mangalore Port Authority (NMPA) — from discharging her official duties on June 9.

Panambur police registered a case against the former MLA of Mangaluru City North after the Secretary of the NMPA filed a complaint against him on June 10. The case was filed under the relevant provisions of the Bharatiya Nyaya Samhita with charges of attempt to suicide to compel or restrain a public servant from discharging official duty, use of criminal force to prevent a public servant, threat to a public servant to influence official action, obstructing a public servant and wrongful confinement and wrongful restraint.

Addressing presspersons here on Friday, June 13, Mr. Bava, who was elected to the Legislative Assembly from the Congress in 2013, said that he behaved decently and conducted himself respectfully when met the Deputy Chairperson on June 9 in connection with demand for settling a pending bill of a sub-contractor.

“A false complaint was filed against me 26 hours after meeting the Deputy Chairperson,” the former MLA said.

Mr. Bava said that the footage of CCTV cameras can be checked to ascertain whether he behaved in an uncivilised manner with the official concerned.

The former MLA said that when the sub-contractor told him that ₹1.50 crore of ₹2.60 crore was due from the NMPA he visited the office of Chief Engineer of the authority on June 6. An official there told the MLA that after withholding ₹5 lakh the remaining amount will be released. But when the amount was not credited, he was asked to meet the Deputy Chairperson. Hence he could meet the Deputy Chairperson only at 8 p.m. on June 9 as earlier on the day, the MLA was told, she was busy with board meeting and other official works.

“I only requested the Deputy Chairperson to release the bill amount after withholding ₹5 lakh as approved by the office of Chief Engineer,” the former MLA said. Mr. Bava said that he and his associates did not waylay the car of the official when leaving the office on June 9.

The former MLA said that he will file a complaint with Mangaluru Police Commissioner on what Mr. Bava said “false complaint” filed against him.
