Granting bail with conditions to a man who was arrested and remanded in judicial custody for the possession of banned tobacco products, the Madurai Bench of the Madras High Court directed him to make a non-refundable deposit so that the amount could be utilised for the purpose of purchasing furniture (Benches and Desks) for newly constructed classrooms under ‘Namakku Naame Thittam’.
The court was hearing a petition filed by Murugesan who was arrested by the Alangulam police in Tenkasi district and remanded in judicial custody on November 20.
The case of the prosecution is that the accused in the case were found in possession of 525 kg of banned tobacco products.
The petitioner said he was innocent and had not committed any offence as alleged by the prosecution. The State submitted that five cases of similar nature were pending against the petitioner and opposed granting of bail to the petitioner.
Justice S. Srimathy directed the prosecution to produce the accused who was in jail as well as his wife, another accused in the case. Both submitted an undertaking to the court stating that they will not sell any tobacco products in future.
Taking into consideration the facts and circumstances of the case and the undertaking filed by the accused persons, the court held that it was inclined to grant bail to the petitioner with conditions.
The petitioner was directed to make a non-refundable deposit of ₹3,000 to the credit of The Headmaster of the Government Higher Secondary School in Odaipatti in Theni district.
The fund shall be utilised for the purpose of purchasing furniture (Benches and Desks) for newly constructed classrooms under ‘Namakku Naame Thittam’, the court directed. The petitioner was also directed to report before the Alangulam police every day at 10.30 a.m. till further orders.
