NGT slaps ₹50,000 fine on DJB for repeated delays in groundwater case

Expressing displeasure over repeated delays, the National Green Tribunal (NGT) has fined the Delhi Jal Board (DJB) ₹50,000 for consistently seeking adjournments in a case related to illegal groundwater extraction by hotels.

The applicant in the case alleged that the DJB was “deliberately” seeking adjournments and “obstructing” the proceedings.

“When the matter was listed on 26.03.2025, a letter was circulated by Respondent No. 5, the Delhi Jal Board (DJB)… The plea for adjournment made by the DJB was accepted, and the matter was adjourned. Today again, a letter has been circulated by the DJB seeking adjournment mechanically,” the NGT stated in its order dated July 7.

Repeated adjournments by the DJB on the same ground that the “counsel is not in station” do not appear to be bona fide. The applicant’s allegation seems to carry weight, the order said.

“Hence, in the circumstances, there is no option but to adjourn the matter with a cost of ₹50,000 imposed on the DJB. This amount shall be deposited within one week with the Secretary, NGT Bar Association,” it said.

The tribunal directed that the amount be utilised within two months by the NGT Bar Association to purchase books on environmental protection for the NGT Bar Room. It said a receipt of the purchase must be submitted to the Registrar General, NGT.

“The conduct of the DJB in such a matter, where execution of an order passed nearly seven years ago is being pursued, is unacceptable. Therefore, we direct the CEO of the DJB to appear on the next date of hearing to assist the tribunal,” said the order.
