HC dismisses appeal by tech varsity V-C

The Kerala High Court has dismissed an appeal filed by K. Sivaprasad, Vice-Chancellor of APJ Abdul Kalam Technological University, challenging an interim order of a Single Bench that declined to grant interim relief regarding his contention that there was an administrative stalemate in the university.

Dismissing the plea, a Division Bench of Justice Anil K. Narendran and Justice Muralee Krishnan S. said the interim relief sought in the writ petition and in the main relief was essentially the same, and there was no reason to interfere with the interim order.

The V-C had submitted in his plea that there were nine members in the Syndicate, of which three abstained from the Syndicate meetings for ‘political reasons.’ This had resulted in the disbursal of its meetings for want of quorum.

In addition, employees were not paid their wages for the past month, as the university’s budget had not been passed due to ‘non-cooperation’ of the State government. Likewise, pension was not disbursed to pensioners for the past two months as the budget had not been passed, he had submitted before the court earlier this month, as examples of the alleged stalemate.
