The Delhi High Court on Wednesday directed Priya Kapur, wife of late businessman Sunjay Kapur, to disclose details of all his movable and immovable assets till June 12, the day of his death. The court issued the notice after Sunjay’s two children with his former wife, actor Karisma Kapoor, challenged the validity of a will that purportedly bequeaths all of his personal assets to Ms. Priya.
The two children, Samaira Kapur, 20, and Kiaan Raj Kapur, 15, have alleged that the will purportedly executed by their father is “forged and fabricated”. Their petition has sought directions from the court to restrain Ms. Priya from acting on the contested will, thereby denying their inheritance. They said that as Class I legal heirs under Indian succession laws, they are entitled to their respective shares in their father’s estate.
During the hearing, Ms. Priya’s counsel argued that the children had already received a beneficial interest in assets valued at over ₹1,900 crores through the family trust.
When the judge asked whether the will was registered, the counsel submitted that though the will was not registered, it wasn’t “invalid”. “It’s not registered. There is a judgment which says an unregistered will does not take the validity away. When I set up the will, my lady (judge) will be entitled to examine if it is suspicious in nature,” the counsel said.
The court posted the matter for October 9.
Mother contests will too
Sunjay’s mother, Rani Kapur, has also challenged the will, saying there was nothing left to her. “I have written at least 15 emails asking about the will, what are the documents? Not a word has been shared. I have been told that my emails have been compromised. ₹10,000 crore worth of assets should have been mine,” the 80-year-old’s counsel, senior advocate Vaibhav Gaggar, argued.
Meanwhile, Ms. Priya’s counsel reminded the court of Ms. Karisma’s divorce case proceedings with Sunjay which ended in the Supreme Court. “There were litigations after litigations which ultimately culminated in a bitter divorce process ending in the Supreme Court. Please have some sympathy for the soul of the deceased. I (Priya) have a 6-year-old child. I am a widow. I am his last wife,” the counsel said.
Ms. Karisma and Sunjay got married in September 2003 and divorced in June 2016. Sunjay married Ms. Priya in April 2017 and had one child with her.
