Sinking of MSC Elsa 3: HC permits publishing of details of admiralty suit

The Kerala High Court has permitted the owners of MSC Elsa 3, a container-laden ship that sank off the Kerala coast on May 25, to publish in newspapers details of an admiralty suit they had filed to limit the liability for maritime claims that arose from the damage to the environment and other losses following the vessel’s sinking.

The owners had filed an admiralty suit before the High Court, seeking limitation of liability for compensation claims worth ₹9,531 crore for marine and coastal pollution, subsequent loss of livelihood caused to fishers, and the ‘‘remediation’’ measures following the sinking of the vessel.

About a dozen fishing boat operators had approached the High Court seeking compensation for damage suffered by their boats after running into containers that fell off the vessel. They had sought the arrest of a sister vessel of MSC Elsa 3.
