Punjab and Haryana High Court issues notice to Haryana government on PIL over roads and traffic management in Gurugram

The Punjab and Haryana High Court on Thursday issued notice to the Haryana government on a Public Interest Litigation (PIL) petition by a bunch of Gurugram residents seeking direction to improve the condition of roads in and around South City1, act on the traffic and security management and remove encroachments in the area.

The Division Bench of Chief Justice Sheel Nagu and Justice Sanjiv Berry issued the notices to the government, Haryana Shehri Vikas Pradhikaran (HSVP), Municipal Corporation Gurugram and other authorities on the plea filed by Brigadier Paramjit Singh and former Special Director, NIA, Navneet Rajan Wasan, among others.

The 150-page petition, with annextures, said several substantive questions of law arise from the plea such as whether the petitioners were being denied their right to life and of livelihood as enshrined under Article 21 of the Constitution; whether the act of the official respondents was whimsical thereby prejudicing the just rights of the petitioners and whether the arbitrary action of the official respondents was in violation of the basic principles of natural justice.

There was no remedy of appeal or revision available to the petitioners and were left with no alternative except to approach the court, said the petition filed by counsel Yamini Nain.

Saying that no action was being taken on the Detailed Project Reports (DPR) for construction of roads, the petition said: “The DPR tries to resolve the issue but in actuality it remains unresolved as not action is being taken on the DPRs The local authorities refuse to take any action.”

Representing the petitioners, advocate Varun Singh Dhanda said the roads were in a pathetic state and people were suffering due to encroachment and traffic issues. He said the petitioners have approached the court for the implementation of the DPR prepared by the authorities.
