RG Kar rape and murder case: Sealdah court rejects victim’s kin’s plea to revisit crime scene

The court of the Additional Chief Judicial Magistrate at Sealdah on Wednesday (July 9, 2025) rejected the plea by the family of the RG Kar victim to access the crime scene, raising questions on whether the family’s lawyers want to carry out a parallel investigation.

It is worth noting that the Central Bureau of Investigation (CBI), which investigated the doctor’s rape and murder case, is currently probing alleged evidence tampering and larger conspiracy behind her death.

During a hearing on the matter the day before, the family’s plea for access to the place of occurrence was unanimously opposed by lawyers representing the West Bengal government, and lawyers representing the former principal of RG Kar Medical College and Hospital, Sandip Ghosh, and the former officer-in-charge of Tala Police Station, Abhijit Mondal. Mr Ghosh and Mr Mondal are accused of tampering with evidence.

On the other hand, the CBI had not submitted any objections to the plea.

“The court rejected our application to visit the place of occurrence, citing the ongoing investigation. However, the court observed that the State’s statement against our visiting the crime scene was identically reflected in the submissions by Mr Ghosh and Mr Mondal. The two accused adopted the arguments of the State… this makes it even clearer that the State and the people accused of evidence tampering are on the same side,” the family’s legal counsel said after the hearing on Wednesday.

The family’s lawyer also mentioned that the court had questioned the CBI’s no-objection to the family’s plea and had raised concerns over their ongoing probe into the case. 

“Our allegations, regarding tampering with evidence in light of an institutional murder and a larger conspiracy, found more merit in the court’s observations today,” the family’s lawyer said, adding that they are yet to decide whether to appeal to a higher court.

Meanwhile, parents of the doctor who was raped and killed at RG Kar Medical College and Hospital (RGKMCH) last year, have alleged that the CBI did not properly look into the findings of forensic reports, particularly pertaining to the scene of crime and the collected DNA evidence.   

“During court proceedings, many questions are asked about the scene of crime, which our current lawyers had not seen themselves. So it was imperative they visited it,” the father of the victim said. They had approached the Sealdah court on Monday (July 7, 2025), seeking its permission to revisit the crime scene. 

On August 9, their daughter, a postgraduate trainee doctor at RGKMCH, was found raped and killed in a seminar hall of the chest medicine department on the fourth floor of the hospital’s emergency building.

Dr Saptarshi Chatterjee, the current medical superintendent and vice principal of RGKMCH, said on Tuesday that the seminar room remained sealed since the incident, with a guard present outside at all times and “do not cross” labels around it.  

In related developments, the West Bengal Junior Doctors’ Front has called for a torch rally from College Square and a protest gathering at Shyambazar on the night of August 8, followed by agitations on August 9, marking one year since the unfortunate incident. The parents of the victim had earlier said that they would participate in the ‘Nabanna Abhiyan’ (march to State Secretariat) rally against the State government on August 9, 2025.
