Hyderabad parliamentarian Asaduddin Owaisi on Wednesday (August 20, 2025) opposed the introduction of the three bills in the Lok Sabha that enable the removal of Prime Minister, Chief Ministers, Union Ministers and Ministers in States and Union Territories who are arrested and detained on serious criminal charges.Â
Speaking to The Hindu, Mr. Owaisi said that he has given notice to oppose the introduction of The Constitution (130th Amendment) Bill, 2025, The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025 and The Government of Union Territories (Amendment) Bill, 2025.
The All India Majlis-e-Ittehadul Muslimeen (AIMIM) president said that his opposition was on the grounds that the amendments would give executive agencies wide, sweeping powers which would enable them to become judge, jury and executioner. Any Chief Minister or minister would be detained on mere suspicion, and baseless allegations. Pointing to two scenarios, Mr. Owaisi said that it is only after the Prime Minster and Chief Minister, who are heads of government, recommend removal that ministers can be removed, or if the Council of Ministers lose confidence.
âThey want to turn the country into a police state. This is the quintessential 1933 moment which saw the formation of the Gestapo [in Nazi Germany],â Mr. Owaisi told The Hindu even as he drew attention to the gravity of the situation. He pointed out that the move would deal a massive body-blow to democracy and federalism
He emphasised that it was not arrest, but mere detention for a period of 30 days would lead to the removal of the ministers. He said that political leaders such as N. Chandrababu Naidu, Hemant Soren and Arvind Kejriwal were in jail for extended periods of time. He pointed out that sections of the Bharatiya Nyaya Sanhita, including Section 152, and Section 4 of the Prevention of Money-Laundering Act could be invoked arbitrarily for detention or arrest.
âI am opposing the very introduction of these Bills,â he said. The Hyderabad MP said that the move would force elected representatives, who are accountable to the public, to be accountable to executive agencies which report to the Union government, such as the Central Bureau of Investigation, and Enforcement Directorate, as it would leave them to their mercy. The All India Services officers are under the Department of Personnel and Training, a concern of the Centre.
