The Madurai Bench of the Madras High Court has sought response from the State to a public interest litigation petition seeking a direction to the State to constitute the State and district-level police complaints authority in Tamil Nadu.
A Division Bench of Justices Anita Sumanth and C. Kumarappan sought response of the State on a petition filed by P. Ayyakannu of Tiruchi. The petitioner sought a direction to the State to constitute the State and the district-level authorities as per the Supreme Court’s judgment in 2006.
As per the Supreme Court’s judgment, there should be a police complaints authority at district level to look into the complaints against the police officers up to the rank of Deputy Superintendent of Police, he said.
Similarly, there should be a police complaints authority at State-level to look into the complaints against the police officers of the rank of the Superintendent of Police and above, he said.
The district level police complaints authority may be headed by a retired district judge, while the State-level authority may be headed by a retired High Court judge, he said. The court has posted the matter for hearing after two weeks.
